Proposed Reissuance of the AZPDES De Minimis General Permit

On June 8, 2026, the comment period begins for the proposed reissuance of the Arizona Pollution Discharge Elimination System (AZPDES) De Minimis General Permit. The comment period ends July 8, 2026.

ADEQ is reissuing the Arizona Pollutant Discharge Elimination System (AZPDES) De Minimis General Permit (DMGP) for de minimis discharges of pollutants to Protected Surface Waters in Arizona, pursuant to 18 Arizona Administrative Code (А.A.C.) 9, Article 9, R18-9-C901 and -C903, and in accordance with federal conditions for WOTUS and state conditions in A.R.S Title 49 Chapter 2, Article 3.1 et seq. (non-WOTUS).

State requirements for discharges to non-WOTUS protected surface waters are adopted pursuant to Arizona Revised Statutes (A.R.S.) § 49-255.04 and are enforceable solely by ADEQ. Under the federal Clean Water Act and associated regulations (40 CFR 122), and under ARS §49-255 et seq. for Arizona, all point source discharges to surface waters require some type of discharge permit coverage.

As an alternative to obtaining individual AZPDES permits, the proposed general permit provides coverage for qualifying discharges that have the potential to enter surface waters, whether directly or via a storm sewer system or other conveyance. This includes discharges from potable water systems, subterranean dewatering, well development and maintenance, hydrostatic testing, reclaimed water discharges and other miscellaneous discharges.

The reissued De Minimis General Permit will be identified as AZG2026-001 and will replace the existing permit AZG2021-001.

The permit requires the City of Mesa to continue to implement and maintain a Stormwater Management Program designed to reduce the discharge of pollutants to the maximum extent practicable. The permit establishes measurable criteria to assess the efficacy of control measure design and implementation.
