A public comment period for Reopening No. 113040 was open December 31, 2025, to February 2, 2026. ADEQ has reopened the comment period.

On May 27, 2026, a new comment period begins for the proposal to issue a significant revision to an Air Quality Control Permit for Arizona Electric Power Cooperative, Inc. (AEPCO) at the Apache Generating Station in Cochise County, Arizona. The comment period ends July 2, 2026.

EPA Petition Process:

This permit is subject to review by EPA pursuant to 40 CFR 70.8 (Code of Federal Regulations) and Arizona Administrative Code R18-2-307. If EPA does not object to the issuance of this permit, you may petition to EPA within 60 days after the expiration of EPA's 45-day review period. A petition shall be based only on objections to the permit that were raised with reasonable specificity during the public comment period, unless the petitioner demonstrates that it was impracticable to raise such objections within such period, or unless the grounds for such objection arose after such period. Any person who petitions to EPA pursuant to 40 CFR 70.8(d) shall notify ADEQ by certified mail within 10 days after such petition.

On May 26, 2026, the public comment period begins for the proposal to designate the East Verde Estates community located in Gila County, Arizona, as a Nitrogen Management Area. The comment period ends on Sept. 23, 2026.

Details: 

ADEQ is proposing to designate the East Verde Estates community, serviced by the Payson Water Company – East Verde Estates community water system, as a Nitrogen Management Area (NMA).1 The designation serves to regulate and reduce existing or potential nitrate groundwater contamination caused by sources of nitrogen that are not monitored after permit issuance, primarily on-site wastewater treatment systems, also known as septic systems.

East Verde Estates is located approximately six miles north of the town of Payson, off Arizona State Route 87.
