ADEQ Takes Action Against Thatcher Company of Arizona, Inc. for Hazardous Waste Violations

Notice of Violation Issued Following Chemical Spill and Improper Waste Handling

PHOENIX (July 26, 2024) – The Arizona Department of Environmental Quality (ADEQ) today announced that it has completed a thorough onsite inspection at the Thatcher Company of Arizona, Inc. facility located in Buckeye, Arizona and issued a Notice of Violation alleging multiple infractions of federal and state environmental laws. This action followed the facility’s spill of more than 10,000 pounds of nitric acid on June 21, 2024, which caused a large yellowish-brown cloud of nitric oxide gas to be released into the air and led to community evacuations and shelter-in-place alerts due to air quality concerns. ADEQ’s Emergency Response Unit (ERU) reached out to the local incident command to offer help with air quality monitoring and support. On-scene fire officials confirmed that ERU assistance was not needed. 

“This incident at Thatcher Company's facility was unacceptable. Releases of hazardous materials can endanger the health and safety of people and families living nearby,” said ADEQ Waste Programs Division Director Julie Riemenschneider. “We deeply appreciate the swift actions of the first responders who quickly stepped in to protect the community. ADEQ is committed to holding this facility accountable and working with them to help prevent future incidents. Our top priority is the safety and well-being of all Arizonans.”

In an effort to protect the community and ensure the safety of nearby residents, ADEQ inspectors visited the facility on June 28, 2024, as soon as fire officials cleared the scene and ADEQ verified that the facility was back in operation. “Hazardous waste facilities must adhere to the stringent safety protocols,” Riemenschneider added. “It is crucial for these facilities to have emergency planning, including notification to the local emergency authority. These requirements are designed to protect our communities and ensure that responses to potential hazards are swift and effective.”

ADEQ remains dedicated to protecting public health and the environment and will work closely with the facility to prevent future incidents and ensure compliance.
