Hazardous Waste Application Forms & Guidance

A hazardous waste permit application consists of two parts:
- Part A contains the Environmental Protection Agency (EPA) Resource Conservation and Recovery Act (RCRA) Notification of Regulated Waste Activity Form (8700-12) and Hazardous Waste Permit Part A Form (8700-23).
- Part B contains narrative descriptions of the applicant’s waste management procedures, the waste analysis plan, procedures to respond to emergencies, the time-of-closure cleanup plan for the facility, and any other requirements found in 40 CFR Part 270 | View Code of Federal Regulations >

To apply for a hazardous waste permit, you must have:
- An initial application submittal fee | Learn More >
- An electronic application consisting of Parts A and B (permitting staff may request hard copies to assist in the review and public comment process), including original digital signatures as applicable.
- Character Background Reference forms for the permit applicant (i.e., the facility applying for the permit) and for other persons, such as key employees (e.g., emergency coordinator, plant managers and other decision makers regarding hazardous waste operations), corporate directors, corporate officers and owners of 10 percent or more of the debt or equity of the company (persons other than the permit signatory). - Certification of compliance with the EPA RCRA Expanded Public Participation Rule , including a pre-application public meeting in the local community | View >

Types of Applications1
Facilities Applying for First-Time Permits
Existing hazardous waste management facilities should submit their applications within 180 days of the publishing of the regulations that require them to comply with TSDF standards or within 180 days of receiving a request to submit a Part B application by ADEQ.
New hazardous waste management facilities must submit the application and receive the hazardous waste permit prior to beginning the physical construction of the hazardous waste management facility (the parts of the facility that require TSDF regulation). All applications must be submitted at least 180 days prior to construction commencement.
ADEQ aims to review and process all applications within 180 days, but new facilities have additional review and report requirements that may extend this timeframe. Reach out to our hazardous waste permitting staff to discuss requirements and timing of your application.
Facilities Applying for Renewal Permits
Existing permitted facilities must submit the renewal application 180 days prior to the expiration of your existing permit unless granted an extension by ADEQ. We recommend reaching out 270 days prior to the expiration of your permit to discuss fees, potential facility changes, and review timeframes.
ADEQ aims to process renewal applications within 180 days, but more complicated renewals may take additional time. Please reach out to our hazardous waste permitting staff to set up a meeting and discuss the timing of your application submission.

Facilities Applying to Modify a Permit
Facilities wishing to modify their existing permit should submit the electronic modification request to our hazardous waste permitting staff. The different modification classes and what changes are included can be found in 40 CFR Part 270.42.
Class 1 permit modifications, not requiring Director approval, must be submitted within seven calendar days of the change and do not require an application fee. ADEQ aims to acknowledge this change within 45 days.
Class 1 permit modifications requests, requiring Director approval, must be submitted prior to implementing the change and have an application fee. ADEQ aims to process these requests within 90 days.
Class 2 and 3 permit modification requests are more complicated and must be submitted prior to implementing the change along with the associated application fee. ADEQ aims to process these more complicated modification requests within 180 days.
