Waters of the United States (WOTUS)

In December 2018, the Environmental Protection Agency (EPA) announced that they intended to publish a new definition for Waters of the United States (WOTUS). The EPA is reviewing comments and intends to publish a new definition in early 2020. If published as proposed, the definition change would remove federal environmental protections for many Arizona waters, and the State will be responsible for protection of any non-WOTUS surface waters in Arizona. ADEQ is in the early stages of gathering input and guiding principles for a Waters of Arizona (WOAZ) program. When the new definition was proposed, ADEQ gathered stakeholder input in early 2019, through stakeholder meetings and comment submissions.
