This form serves to notify ADEQ about activities taking place within the ordinary high-water mark of perennial or intermittent non-WOTUS protected surface waters or within the bed and bank of other waters that materially impact (i.e., are within 1/4 mile of) non-WOTUS protected surface waters. These are considered “regulated activities.” It is required that regulated activities follow best management practices to prevent any violation of applicable surface water quality standards in non-WOTUS protected surface waters.
When must I submit a Notice Form for Regulated Activities Requiring Best Management Practices for non-WOTUS Protected Surface Waters?
When you are completing activities within the ordinary high-water mark of perennial or intermittent non-WOTUS protected surface waters or within the bed and bank of other waters that materially impact (i.e., are within 1/4 mile of) non-WOTUS protected surface waters unless an exclusion applies.

Exclusions
- Activities that are already regulated under A.R.S. Title 49.
- Discharges to a non-WOTUS protected surface water incidental to a recharge project.
- Established or ongoing farming, ranching, and silviculture activities such as plowing, seeding, cultivating, minor drainage or harvesting to produce food, fiber or forest products, or upland soil and water conservation practices.
- Maintenance but not construction of drainage ditches.
- Construction and maintenance of irrigation ditches.
- Maintenance of structures as dams, dikes, and levees.
Fees
At this time, there are no fees associated with the Notice Form for Regulated Activities Requiring Best Management Practices for non-WOTUS Protected Surface Waters.
