Summary:

ADEQ is pursuing a regular rulemaking to amend Arizona Administrative Code (A.A.C.) Title 18, Chapter 18, Article 1 (Emergency Planning and Community Right to Know) to update the Tier II Emergency and Hazardous Chemical Inventory Reporting fees in order to provide critical equipment to local emergency response departments. In this rulemaking, ADEQ will determine how to best adjust the fee structure in R18-18-107(B), increasing fees and adjusting annual fee caps, in order to address the budgetary shortfalls facing the Emergency Response Fund while imposing the least burden on the regulated community.
