Summary:

ADEQ is pursuing a regular rulemaking to amend Title 18, Chapter 11, Section 216 “The Protected Surface Water List,” Table B “WOTUS Protected Surface Waters,” by adding a protected surface water. ADEQ seeks to add a mitigation wetland established by the Bureau of Land Management (BLM) as a protected surface water under Appendix B and assign appropriate water quality standards to this wetland.
