Summary:
ADEQ identified the need for technical corrections to the Title 18, Chapter 16 WQARF rules of the Arizona Administrative Code during the prior five-year review of 18 A.A.C. 16. ADEQ decided that an expedited rulemaking was appropriate pursuant A.R.S. § 41-1027(A) because it will not increase the cost of regulatory compliance, increase a fee or reduce procedural rights of persons regulated and will merely correct typographical errors, makes address and name changes, and clarify language without changing its effect, as well as amend outdated and redundant rules pursuant to subsections (3) and (6), respectively. The changes made in this rulemaking included correcting citations, updating references, and clarifying the rule text’s language. Summary
This rule increased certain hazardous waste fees as authorized by A.R.S. §§ 49-922(B)(5) and 49-931(A). ADEQ had last increased hazardous waste fees in 2012 (18 A.A.R. 1202). This rule increased two hazardous waste fees beginning April 1, 2023, to address the future direct and indirect costs of ADEQ’s relevant hazardous waste duties, including employee salaries and benefits, professional and outside services, equipment, in-state travel, and other necessary operational expenses directly related to issuing hazardous waste permits and enforcing the requirements of the regulatory program. The rule helped us maintain authorization from the United States Environmental Protection Agency to enforce federal hazardous waste laws in Arizona.
