Onsite Wastewater Treatment Facilities

Summary:

ADEQ is in the process of conducting rulemakings to update and significantly amend rules related to onsite wastewater treatment facilities program (OWTFs or “onsite facilities”), found in Title 18, Chapter 9 of the Arizona Administrative Code (and related license and fee chapters), pursuant to stakeholder recommendations for regulatory updates to the OWTF permitting program. ADEQ last amended the program in a limited update rulemaking effective June 19, 2023 (see 29 A.A.R. 1023 (May 12, 2023)). The last substantial rulemakings related to OWTFs were in 2001 and 2005 (see generally 7 A.A.R. 237 (Jan. 12, 2001) and 11 A.A.R. 4544 (Nov. 14, 2005), respectively). 

The rulemakings aim to amend rules related to the OWTF general permit program, restructuring many programs under the OWTF rules including general permits, proprietary products, inspection and notice of transfer, and service providers. The substantive, programmatic amendments aim to achieve stakeholder-identified goals of creating a more progressive permitting structure, increasing flexibility of the general permit program, and enhancing human health and the environment through additional protective requirements.
