PUBLIC NOTICE | Proposal to Issue Air Quality Permit to Boral Materials LLC in Yavapai County

ADEQ proposes to issue Air Quality Control Permit No. 89020 to Boral Materials, LLC for the construction and operation of a pozzolan mining and processing facility located in Yavapai County. The facility is subject to the requirements of the Federal Clean Air Act, Code of Federal Regulations, Arizona Revised Statute 49-426, and the Arizona Administrative Code, Title 18, Chapter 2. The facility emits the following air contaminants: particulate matter (PM), particulate matter with a diameter less than 2.5 microns (PM2.5), particulate matter with a diameter less than 10 microns (PM10), nitrogen oxides (NOX), carbon monoxide (CO), volatile organic chemicals (VOC), lead (Pb) and hazardous air pollutants (HAPs) in the form of arsenic, chromium and nickel.

People who file comments on the permit will have the right to appeal the final decision as an appealable agency action to the Office of Administrative Hearing (OAH) pursuant to §41.1092.03, and the appeal must be filed within 30 days after the issuance of the final decision. The OAH may sustain, modify or reverse the final decision.
