Background

A consistent question from participants of ADEQ stakeholder sessions regarding the new WOTUS rule has been, “Which facilities need a Clean Water Act permit?”  While the federal tools we need to assist us in making jurisdictional water determinations have yet to be released, ADEQ has developed an initial screening toolkit to provide guidance to Arizona permittees. Tribes may want to coordinate with  the U.S. Environmental Protection Agency and the U.S. Army Corp of Engineers to inquire if these tools are relevant to the unique circumstances of their Nation.

The initial toolkit includes several tools that can be used to evaluate permit applicability. Flow tracing tools, data analysis and risks identification are key components, and additional tools may be added following robust review and as needed.

We know that Tribes have unique and real concerns about the protection of Arizona's unique environment outside of their sovereign nations.
